1. Acceptance of Terms
By accessing or using Pinned Eats ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Description of Service
Pinned Eats is a two-sided marketplace that connects customers with food trucks. Customers can discover nearby food trucks, browse menus, and pre-order. Vendors can manage their menu, schedule, accept bookings, and promote their business. The Platform serves as an intermediary and does not employ, supervise, or control vendors or their employees.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You may not create accounts for others without their permission.
4. Vendor Terms
Free Tier. Vendors on the Free tier may list their profile and menu, and toggle their live/offline status. No payment is required.
Pro Subscription. The Pro tier costs $9.95/month and includes employee accounts, calendar scheduling, booking management, and social media integration. Subscriptions are billed monthly via Stripe and auto-renew unless canceled. You can cancel at any time; access to Pro features continues until the end of the current billing period.
Vendor Responsibilities. Vendors are responsible for the accuracy of their menu, schedule, and location information. Vendors must fulfill all accepted pre-orders. Failure to do so may result in account suspension.
5. Customer Terms
Pre-orders placed through the Platform are agreements between you and the vendor. The Platform facilitates the transaction but is not responsible for order fulfillment, food quality, or vendor cancellations. If you have an issue with an order, please contact the vendor directly.
6. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Impersonate any person or entity
- Attempt to gain unauthorized access to any part of the Platform
- Interfere with the operation of the Platform
- Post false, misleading, or fraudulent information
- Harass, abuse, or harm other users
- Use automated means (bots, scrapers) without our permission
7. Intellectual Property
The Platform and its original content, features, and functionality are owned by Pinned Eats and are protected by applicable intellectual property laws. Vendor-provided content (logos, menu items, descriptions) remains the property of the vendor.
8. Limitation of Liability
To the fullest extent permitted by law, Pinned Eats shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. The Platform is provided "as is" without warranties of any kind, either express or implied.
9. Termination
We reserve the right to suspend or terminate accounts at our discretion, particularly for violation of these terms or for conduct that we believe could harm the Platform or its users. You may cancel your account at any time through your account settings.
10. Changes to Terms
We may modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new terms.
